Travel ViVo – Terms and Conditions

Welcome to Travel ViVo (www.travelvivo.co.uk). These Terms and Conditions (“Terms”) govern the provision of our services to you (“Client,” “You”). By engaging Travel ViVo for services, you agree to be bound by these Terms.

1. Definitions

  • “Travel ViVo,” “We,” “Us,” “Our”: Refers to Travel ViVo (www.travelvivo.co.uk).
  • “Client,” “You,” “Your”: Refers to the individual or entity engaging our services.
  • “Services”: Refers to the Language Test Facilitation, Student Application, Tuition, and Leasing Support, and Accommodation Services for International Students, as detailed on our website and in any specific Service Agreement.
  • “Service Agreement”: Any separate document or written communication (e.g., email confirmation) outlining the specific scope of services, deliverables, and any specific terms agreed upon for an individual Client.

2. Our Services

  • 2.1 Scope of Services: Travel ViVo provides bespoke consultancy and facilitation services to international students. The precise nature and scope of the Services provided to you will be detailed on our website and may be further particularised in a Service Agreement or through written communication. Our services include:
    • Language Test Facilitation: Providing guidance and information regarding language proficiency tests for UK study. We do not administer tests.
    • Student Application, Tuition, and Leasing Services: Assisting with university/college applications, understanding tuition fee structures, and guidance on leasing agreements. We do not guarantee admission or specific leasing terms.
    • Accommodation Services for International Students: Assisting in finding suitable accommodation. We are not a landlord or letting agent but a facilitator.
  • 2.2 Tailored Services: As our services are tailored to individual circumstances, the specifics of the service delivery will be discussed and agreed upon with you prior to the commencement of substantive work.
  • 2.3 No Guarantees: While we strive to provide the best possible advice and support, Travel ViVo does not guarantee any specific outcomes, such as university admission, visa approval, successful language test results, or the securing of specific accommodation or leasing terms. These outcomes are often dependent on third-party decisions and individual Client efforts.

3. Client Obligations

  • 3.1 Accurate Information: You agree to provide accurate, complete, and timely information as required by Travel ViVo to perform the Services. We are not liable for any issues arising from inaccurate or incomplete information provided by you.
  • 3.2 Cooperation: You agree to cooperate reasonably with Travel ViVo to enable us to provide the Services effectively.
  • 3.3 Compliance with Laws: You are responsible for complying with all applicable laws and regulations, including visa requirements and institutional policies.

4. Fees and Payment

  • 4.1 Service Fees: The fees for our Services will be communicated to you and agreed upon before the commencement of substantive work. As our services are tailored, fees are determined on a case-by-case basis.
  • 4.2 Invoicing and Payment:
    • Upon completion of the agreed-upon Service or specific milestones as defined in a Service Agreement, Travel ViVo will issue an invoice to you.
    • Payment is due within 5 days from the date of the invoice, unless otherwise agreed in writing.
    • Payment shall be made via the methods specified on the invoice.
  • 4.3 Late Payments: If you fail to make payment by the due date, Travel ViVo reserves the right to:
    • Charge interest on the overdue amount at a rate of 4% per annum above the Bank of England base rate, from the due date until payment is made.
    • Suspend any further Services until payment is received in full.
    • Engage debt collection services to recover the outstanding amount, and you will be liable for any costs incurred in this process.
  • 4.4 Third-Party Fees: You are responsible for all fees, charges, or expenses payable to third parties (e.g., university application fees, visa application fees, accommodation deposits, language test fees). Our service fees cover our consultancy and facilitation services only.

5. Cancellation and Refunds

  • 5.1 Cancellation by Client:
    • If you wish to cancel a Service, you must notify Travel ViVo in writing.
    • Depending on the stage of service completion at the time of cancellation, a fee may be chargeable for work already undertaken. This will be assessed fairly and communicated to you. 
  • 5.2 Cancellation by Travel ViVo: We reserve the right to cancel or suspend Services if:
    • You breach any material term of these Terms.
    • You fail to provide necessary information or cooperation.
    • We are unable to provide the Service due to unforeseen circumstances (in which case, any pre-payments for unrendered services might be considered for a refund on a case-by-case basis).
  • 5.3 Refunds: Refunds are not generally provided for services already rendered. Any potential refunds will be at the sole discretion of Travel ViVo and considered on a case-by-case basis, particularly in relation to cancellations and the extent of service completion.

6. Limitation of Liability

  • 6.1 Indirect Loss: To the fullest extent permitted by law, Travel ViVo shall not be liable for any indirect, consequential, or special losses, loss of opportunity, or loss of profit.
  • 6.2 Maximum Liability: Our total liability to you for any claim arising out of or in connection with the Services or these Terms, whether in contract, tort (including negligence), or otherwise, shall be limited to the total fees paid by you to Travel ViVo for the specific Service giving rise to the claim.
  • 6.3 Third-Party Actions: Travel ViVo is not liable for the actions, omissions, or decisions of third parties, including but not limited to educational institutions, visa authorities, accommodation providers, or language testing bodies.
  • 6.4 Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation,1 or any other liability which cannot be excluded or limited2 under applicable law.

7. Confidentiality and Data Protection

  • 7.1 Confidentiality: Both parties agree to keep confidential any proprietary or sensitive information disclosed by the other party in connection with the Services.
  • 7.2 Data Protection: Travel ViVo is committed to protecting your privacy. We will process your personal data in accordance with our Privacy Policy (available on our website) and applicable UK data protection legislation, including the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. Our Privacy Policy explains how we collect, use, and protect your personal information.

8. Intellectual Property

  • Any materials, documents, or advice provided by Travel ViVo are for your personal use in connection with the Services and may not be reproduced, distributed, or used for any other commercial purpose without our prior written consent.

9. Dispute Resolution

  • 9.1 Good Faith Negotiation: In the event of any dispute arising from or in connection with these Terms or the Services, both parties agree to first attempt to resolve the dispute amicably through good faith negotiations.
  • 9.3 Formal Proceedings: If the dispute cannot be resolved through negotiation [or mediation], the parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

10. Amendments to Terms and Conditions

  • Travel ViVo reserves the right to amend these Terms and Conditions at any time. Any such amendments will be effective immediately upon posting on our website3 (www.travelvivo.co.uk) or by providing notice to you. Your continued engagement of our Services after such changes will constitute your acceptance of the new Terms. We recommend you review these Terms periodically.

11. Governing Law and Jurisdiction

  • These Terms and Conditions and any dispute or claim arising out of or in connection with4 them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

12.5 Entire Agreement

  • These Terms, along with any specific Service Agreement and our Privacy Policy, constitute the entire agreement between you and Travel ViVo concerning the Services and supersede all prior discussions, agreements, or understandings.
